Dan Moalem reviews the documentary Children of the Enemy

The leading Danish legal news outlet K-NEWS has invited our chairman Dan Moalem to make a guest review of the Swedish documentary Children of the Enemy. The film was part of documentary film festival CPH:DOX and was shown in the category ‘Justice’.

Dan Moalem’s review kickstarts K-NEWS’ series of external film reviews done by notable individuals in the Danish legal market.

Children of the Enemy portrays a Swedish grandfather’s struggle to get his grandchildren back to Sweden from the Syrian refugee camp where they live as orphans after their radicalized parents have been killed fighting for Islamic State.

While admitting that he is an M&A lawyer with no deep insight into the legal particularities in question, to Dan Moalem, the legal questions raised by the documentary seem to be straightforward. The real issue appears to be the politicizing of the law and legislature: ”The fact that Sweden does not appear to have a strong civil service (in Danish: embedsværk) drawing a line for the politicians and clearly stating ‘this is a far as the law can take you’, cannot be in Sweden’s best interest, nor in Denmark’s for that matter.”

Dan Moalem continues: ”It is absolutely distasteful that the Swedish Government acted as if it was the Kurds’ responsibility to take care of the orphaned Swedish children. Obviously, that is not the case in a democracy where the rule of law applies”.
